1. General

Radish B.V. provides tailored qualitative research services for product teams and businesses. Any engagement is subject to a written agreement between the parties. These Terms and Conditions apply in the absence of or in addition to such an agreement.

2. Intellectual Property

Unless otherwise agreed in writing:

• Clients receive a non-exclusive, non-transferable license to use final deliverables for internal business purposes.
• Radish B.V. retains ownership of methods, research frameworks, and materials used or developed during the project.
• Pre-existing intellectual property remains the property of the originating party.

3. Confidentiality

Radish B.V. treats all client information as confidential. Information shared during discovery, research, or delivery will not be disclosed to third parties without prior written consent, except as required by law.

4. Data Protection and GDPR

If a project involves the processing of personal data on behalf of the client:

• Radish B.V. acts as a data processor, and the client as the data controller under the GDPR.
• The parties agree to be bound by Radish B.V.’s standard Data Processing Agreement, unless otherwise agreed in writing.
• Radish B.V. will implement appropriate technical and organizational measures to protect personal data and assist the client in fulfilling their GDPR obligations.

5. Liability

• Radish B.V. delivers services with professionalism and care.
• Liability is limited to the amount paid for services in question.
• Radish B.V. is not liable for indirect damages, business losses, or decisions made based on research outcomes.
